If a Supreme Court judgment on a Constitutional issue is not “educational” (we’ll leave aside the question of art) or, if not an interview, at least “bona-fide news,” then what is? By referring to “the F-word” and “the S-word” rather than “fuck” and “shit,” Kennedy (and, perhaps, the Justices who signed on) only affirms that vagueness and irrationality are at the heart of the Court’s position, as well as that of the F.C.C.
